Welcome to Moto Tap, operated by MotoTap Autosystems ("Moto Tap", "we", "us", or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Moto Tap website and related services (collectively, the "Platform"). By creating an account or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
Moto Tap is a marketplace that connects drivers with mechanics, garages, and parts dealers across Kenya. We provide the technology that helps you discover service providers, request assistance, communicate, and arrange automotive services. Moto Tap is not itself a mechanic, garage, or parts dealer and does not perform automotive work. Any service is provided directly by the independent provider you choose.
You must be at least 18 years old and able to form a legally binding contract to use the Platform. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Mechanic and parts dealer accounts may be subject to review and approval before they become active.
Prices displayed for services or parts are set by the respective mechanics and parts dealers, not by Moto Tap. Any agreement for services or parts is made directly between you and the provider. Moto Tap is not a party to that agreement and is not responsible for the quality, safety, legality, timing, or outcome of any service or part provided. You are responsible for confirming details, pricing, and suitability before proceeding.
Unless expressly stated otherwise, payments for services or parts are arranged and settled directly between you and the provider. You are responsible for paying agreed amounts. Where any loyalty points, rewards, or promotional features are offered, they carry no cash value and may be changed or withdrawn at any time.
The Platform includes messaging features so drivers and providers can coordinate. You agree to use these features lawfully and respectfully, and not to send abusive, fraudulent, harassing, or unlawful content. We may remove content or suspend accounts that violate these Terms or that we reasonably believe harm other users or the Platform.
After a completed job, drivers may rate and review providers. Reviews must be honest, based on genuine experiences, and free of offensive or misleading content. We may moderate or remove reviews that breach these Terms.
You retain ownership of the information and content you submit, but you grant Moto Tap a non-exclusive, royalty-free licence to use it as needed to operate and improve the Platform. You confirm that you have the right to share any content you submit and that it does not infringe the rights of others.
We collect and process personal information to operate the Platform, including account details, location data used for matching, and communications. We take reasonable measures to protect your information and do not sell it. By using the Platform you consent to such processing for the purposes of providing the service.
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Moto Tap makes no warranties, express or implied, regarding the Platform or any provider, and does not guarantee the availability, accuracy, or reliability of listings, matches, or services.
To the maximum extent permitted by law, Moto Tap and MotoTap Autosystems shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your dealings with any provider or from your use of the Platform. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
We may suspend or terminate your access to the Platform at any time if you breach these Terms or if we reasonably believe your use poses a risk to others or to Moto Tap. You may stop using the Platform and request account deletion at any time.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the jurisdiction of the Kenyan courts.
